1.4 We reserve the right to change the terms at any time, and to withdraw or amend the service we provide, or any content on our website without notice. We will not be liable if for any reason our website is unavailable at any time or for any period
2.1 The website is intended to provide information to and support for the NHS for service improvement across cancer and other clinical services.
2.2 Unless otherwise stated, the copyright and other intellectual property rights in all material on the website are owned by us, or our licensors. Users may print and download extracts from the website for your own personal use or for use within an NHS body to enable systems improvement. Copying of the whole or a substantial part of the website is prohibited.
2.3 This licence does not extend to the right to modify or download (other than necessary for normal website page caching and use) the website, or any portion of it, except with our written express consent. This licence does not include any collection and use of substantial portions of the listings or databases for the commercial purpose of resubmission to third parties.
2.4 Users shall not:
2.4.1 use the website in conjunction with data mining tools or similar extraction and data gathering tools;
2.4.2 create and/or publish their own database that features substantial parts of the website, or the contents of the website;
2.4.3 use the content of the website as source marketing material or contact data for any kind of telemarketing, direct marketing, viral or other electronic marketing activity on their own behalf, or for the benefit of another party; or
2.4.4 establish a link to the website from any website without our express written consent.
2.5 Users must not misuse the website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. Users must not attempt to gain unauthorised access to the website, the server on which the website is stored or any server, computer or database connected to the website. Users must not attack the website via a denial-of-service attack or a distributed denial-of service attack.
2.6 We will report any breach of clause 2.5 to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing the users’ identity to them. In the event of such a breach, a users’ right to use the website will cease immediately.
2.7 The Website may include links to third party websites from time to time. Users acknowledge and agree that we will not be responsible or liable for the availability, content or services available from such third party sites.
3.1 We shall process any personal information that users submit to us in accordance with the requirements of the Data Protection Act 1998. It will be processed for the purpose of providing you with access to the website. 3.2 Your personal data will not be made publicly available online. It will not be disclosed to any third party without your consent or unless disclosure is required by law. Any third parties that are given access to your information in accordance with this statement will be required to protect your information and will themselves be required to observe the principles set out in the Data Protection Act. 4.3 Subject to 4.1 above, our liability to you is limited to £1, and we will have no liability for any indirect, special or consequential loss or damage howsoever caused. You will indemnify us, and keep us indemnified, against all and any loss, damages, costs or claims sustained by us arising out of any breach of your obligations arising under this agreement.
4.4 If any user believes that any content on the website contains a defamatory statement, or believes that their own trademark, copyright or other intellectual property rights are being infringed in any way, that user should contact us at the email address given above. We will use reasonable endeavours to respond within a reasonable time.
5.1 If any part of these terms is found to be void or unenforceable, it will be severed from the rest to the extent that it does not affect the validity of the remainder.
5.2 These terms are governed by and construed in accordance with English law. Users agree to submit to the exclusive jurisdiction of the English courts.
